Professional Register Terms of Use 

Introduction

Welcome to the NLBC Regulator Online Professional Register portal (the “Portal”), a student registration platform provided by the National Land Based College (NLBC) and operated by the institution you are registering with (“We”, “Us”, “Our”). By accessing or using the Portal, you (“User” or “Student”) agree to comply with and be bound by these Terms of Use (“Terms”). Please read these Terms carefully before using the Portal.

  1. Acceptance of Terms

By using the Portal, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you must not use the Portal.

2.1 Changes to Terms

We may update these Terms from time to time to reflect changes in laws, regulatory requirements, or our operational practices. We will notify you of any significant changes by posting the revised Terms on the Portal. Your continued use of the Portal following the posting of changes will constitute your acceptance of such changes.

  1. User Responsibilities

3.1 Eligibility
To use the Portal, you must be enrolled as a student at a Landex Member Institution or be a past student of an organisation with the Landex Membership.

3.2 Account Information
You are responsible for ensuring that all information you provide to the Portal is accurate, complete, and up-to-date. You should promptly update your account information to reflect any changes.

3.3 Security
You are responsible for maintaining the confidentiality of your login credentials and are solely responsible for all activities that occur under your account. If you suspect any unauthorised use of your account, you must notify your institution immediately.

  1. Permitted Use

4.1 Use of the Portal
You may use the Portal only for lawful purposes and in accordance with these Terms. You agree not to use the Portal:

  • In any way that violates any applicable local, national, or international law or regulation.
  • For fraudulent purposes or in connection with a criminal offense.
  • To transmit any unsolicited or unauthorized advertising or promotional material.
  • To knowingly introduce viruses, Trojans, worms, logic bombs, or other material that is malicious or technologically harmful.
  1. What information do we collect?

The information we collect and store when you register to use the portal is used to provide information to you regarding professional development in the land-based sector. This may include events related to your areas of interest, relevant information about courses, further study opportunities, support to manage your ePortfolio, information about careers and relevant job opportunities and other communications that may support your studies or wellbeing.

Information that is required to make use of the portal to any degree includes:

  • Name
  • Email address
  • Address
  • The institution you are a current or past student of

If registrants wish to make full use of all features within the portal the following information may also be provided and will be processed and stored:

  • Employment details including if applicable CV and other supporting documents
  • Education details including supporting documents
  • Training details including supporting documents
  • Information around areas of interest selected

5.1 How is your information used?

Your information would be used to send targeted communications by email, to display relevant content to you within the portal and hold a professional register of students who have opted in within this institution. This information will only ever be accessible to the institution(s) you are linked to and the NLBC and their supplier (Fortesium Ltd) who will provide oversight and technical support as required.

Your information may be used by NLBC at a high level to assess themes and trends related to demand for and uptake of events and courses in the land-based sector in order to provide students with a better service and support institutions to meet the demand that exists.

If at any time you wish to be removed from the register an accessible process exists within the solution to request to cancel your registration.  This process ensures that your registration is cancelled and all data relating to your profile is deleted with confirmation to you and your institution when deletion has been completed.

 

 

  1. Consumer Rights and Protection

6.1 Consumer Rights Act 2015
Under the UK Consumer Rights Act 2015, you have statutory rights regarding the quality of digital content provided by us. If the digital content we provide is not of satisfactory quality, fit for purpose, or as described, you may be entitled to a repair, replacement, or refund.

6.2 Consumer Protection from Unfair Trading Regulations 2008
We are committed to ensuring that our practices comply with the Consumer Protection from Unfair Trading Regulations 2008. We will not engage in any unfair commercial practices, including misleading actions or omissions, aggressive practices, or unfair terms.

6.3 Digital Markets, Competition, and Consumers Act 2024
As the Digital Markets, Competition, and Consumers Act 2024 comes into effect, we will ensure that our operations, including data practices and contractual terms, comply with the enhanced consumer protections and digital market regulations introduced by the Act. We are committed to transparency, fairness, and consumer choice in all our dealings.

  1. Intellectual Property

All intellectual property rights in the Portal and the material published on it are owned by NLBC or our supplier (Fortesium Ltd). You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Portal, except as permitted by these Terms.

  1. Limitation of Liability

8.1 General Limitation
To the fullest extent permitted by law, we exclude all liability for any direct, indirect, incidental, or consequential loss or damage incurred by you in connection with your use of the Portal.

8.2 Consumer Rights
Nothing in these Terms shall limit or exclude our liability to you in any way that would be unlawful under applicable law, including your statutory rights under the Consumer Rights Act 2015.

  1. Termination

We may terminate or suspend your access to the Portal immediately, without prior notice or liability, if you breach these Terms or if we are required to do so by law.

  1. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the courts of England and Wales.
